These Terms of Use govern access to and use of toolsforgardeners.com, including its calculators, plant information, garden guides, downloads, and related features. In these Terms, "Tools for Gardeners," "we," "us," and "our" refer to the operator of the Tools for Gardeners website. "You" refers to a visitor or user.
By accessing or using the site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.
Eligibility and permitted use
You may use the site only if you can legally agree to these Terms. If you use the site for an organization, you represent that you have authority to bind that organization.
Tools for Gardeners grants you a limited, revocable, nonexclusive, nontransferable right to access the site for personal, household, educational, or internal business planning, subject to these Terms. You may print or download outputs when the site provides that function. This permission does not transfer ownership of the site or its content.
You are responsible for the information you enter, the decisions you make, and compliance with laws, product labels, permits, property restrictions, water rules, pesticide rules, and other requirements that apply to your activities.
Gardening information and calculator results
The site provides general educational information and planning estimates. Results depend on user inputs, formulas, source data, assumptions, and local conditions. Frost dates, weather, climate, soil, elevation, plant variety, pests, maintenance, and measurement accuracy can all affect real outcomes.
You agree to review the assumptions shown with a tool and independently check important measurements and safety information. Seed packets, current product labels, local authorities, Cooperative Extension offices, and qualified professionals may provide information more specific to your location or situation.
The site does not provide professional horticultural, agricultural, engineering, environmental, medical, veterinary, legal, or financial advice. Do not use it as the only basis for decisions that could affect health, safety, structures, animals, protected land, regulated materials, or substantial property.
Acceptable use
You agree not to:
- use the site for unlawful, fraudulent, deceptive, or harmful activity;
- interfere with site operation, security, availability, or another visitor's use;
- attempt to gain unauthorized access to systems, accounts, source code, or nonpublic data;
- introduce malware, destructive code, excessive automated requests, or other abusive traffic;
- bypass access controls, rate limits, consent controls, or technical protections;
- scrape, copy, republish, or create a substitute database from substantial portions of the site without written permission;
- misrepresent site content, remove ownership notices, or imply our endorsement without permission;
- use site content to train or populate a competing commercial service where that use exceeds rights granted by law; or
- send sensitive, unlawful, infringing, or abusive material through contact channels.
Ordinary search engine indexing and sharing links to public pages are permitted. We may restrict automated access that burdens the site or disregards published technical controls.
Intellectual property
The site design, original text, organization, software, graphics, calculations, and other original materials are owned by or licensed to Tools for Gardeners and are protected by applicable intellectual property laws. Names, logos, and distinctive branding may be trademarks of their respective owners.
Facts, ideas, public data, and methods may not be protected in the same way as original expression. Nothing in these Terms claims ownership over material that belongs to others or is in the public domain. When the site cites an external source, that source retains its own rights.
You may quote a reasonable excerpt for commentary, education, or reference when allowed by law, provided you accurately attribute Tools for Gardeners and link to the relevant page. You may not reproduce a full article, tool interface, collection, or substantial portion of the site for commercial redistribution without prior written permission.
Feedback and communications
If you send a correction, suggestion, tool idea, or other feedback, you grant us permission to use that feedback without restriction or compensation. This does not give us ownership of personal information in your message. Personal information is handled as described in the Privacy Policy.
You represent that you have the right to send any material you provide and that it does not violate another person's rights. We are not required to publish, implement, or respond to feedback.

Tools for Gardeners disclaims all warranties, express or implied, including warranties of accuracy, completeness, availability, fitness for a particular purpose, merchantability, noninfringement, and quiet enjoyment.
We do not warrant that the site will be uninterrupted, error free, secure, or free of harmful components. We do not warrant any garden outcome, yield, planting date, purchasing result, or product performance. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Tools for Gardeners and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost crops, profits, data, opportunities, goodwill, or property, arising from or related to the site.
To the fullest extent permitted by law, our total liability for any claim related to the site will not exceed the greater of the amount you paid us to use the site during the 12 months before the claim or 100 United States dollars. The site is currently offered without a required usage fee. Some jurisdictions do not permit certain liability limits, so these limits may not apply in full.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold Tools for Gardeners harmless from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the site, your violation of these Terms, or material you submit that violates another person's rights. This obligation does not apply where prohibited by law or to the extent a claim results from our own unlawful conduct.
Termination
We may suspend or end access to the site if we reasonably believe you have violated these Terms, created security or legal risk, or abused site resources. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, liability limits, and dispute provisions.
Governing rules and disputes
These Terms are governed by the laws that apply to the site operator, without regard to conflict of law principles, except where consumer law requires otherwise. Any dispute must be brought in a court with lawful jurisdiction over the parties and the claim. Nothing in these Terms removes rights that cannot be waived under applicable consumer law.
Before filing a claim, you agree to contact us and provide a reasonable opportunity to resolve the issue informally. This requirement does not prevent either party from seeking urgent relief or filing within a legal deadline.
General terms
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a reorganization, transfer, or sale of the site.
These Terms, together with policies expressly incorporated into them, are the complete agreement about use of the site and replace prior understandings on that subject.
Changes and contact
We may update these Terms when the site, business practices, or legal requirements change. The effective date identifies the current version. Continued use after an update means you accept the revised Terms to the extent permitted by law.
